They’re never going to get it, but it is an interesting strategy.
If it could be plausibly argued that any executive privilege action over discoverable records harms the defendant’s case, or a judge rules that EP doesn’t apply, and they withhold evidence anyway, then the case stands a good chance of being thrown out.
The silver bullet to any nuisance lawsuit by the Trump admin would be to ask for these things — provided the judge agrees that is relevant to the defense and proportional to the needs of the case, and not an impermissible fishing expedition.
