Attorney here. The MN judge issued a TRO order within 10 minutes after starting an ex-parte hearing (i.e., the dhs attorney was not present). There is simply no way the family’s attorney could have presented sufficient evidence within 10 minutes to meet the legal standard to issue the order, which is a lawyer’s way of saying that the hearing process was obviously deficient. The family’s attorney (and the MN judge) did more harm than good. A judge in Texas is going to look at the 10 minute hearing, laugh, and deny any motions by the family’s attorneys to return the father to Minnesota. The kiddo might get returned to reunite her with her mother.

I would like to remind you all that both Democratic and Republicans administrations have had children in cages in ICE facilities, to very little outrage. What has changed now is the scale and the visibility. It is hard to pity a country like that.
