The opinion of the current DOJ of the lawfulness of the records act is of zero importance. Judges can weigh in on that and the DOJ can state their case.
However such a suit is unlikely to be made under the current DOJ because they will not persecute Trump and because this specific issue will arise after Trump leaves office.
If the next DOJ is serving a democratic president, they will decide whether or not to persecute Trump.
