Just a reminder that most any federal judge can swear in a member of Congress. The tradition of the House Speaker doing it is just that, tradition, there’s no requirement whatsoever in the Constitution or the law that makes the House Speaker the only one that can perform this task.

And I’m sure the Republicans won’t mind at all if the Democrats return the favor in the future.

A U.S. federal district or circuit court judge can administer the oath of office to a newly elected member of Congress in such a scenario, though the situation is unusual and context-dependent. The U.S. Constitution (Article VI, Clause 3) requires members of Congress to take an oath to support the Constitution, but it does not specify who must administer it. In practice, the Speaker of the House typically administers the oath to new members during a formal swearing-in ceremony after a special election, as outlined in House Rules and 2 U.S.C. § 25. However, if the Speaker refuses or is unable to perform this duty, there is no constitutional or statutory prohibition against another official, such as a federal judge, administering the oath.

Why would he swear her in. She is a Democrat and will vote against his party

>“You could swear her in tomorrow, right?” Karl asked pointedly.
>“No, not tomorrow, no, we couldn’t, we wouldn’t,” Johnson said. “There was an exception for two Floridians earlier in this Congress. But the reason was they were duly elected. They had a date set. They flew in all their friends and family and the House went out of session unexpectedly.”
>“So if she flies in friends and family —,” Karl countered.
>“We don’t have a date set. She was elected after we were out of session,” Johnson said
*”But the reason was they were duly elected”* No shit, so it she, first sign he’s not genuine.
*”They had a date set”* So what? all that is doing is making sure everyone is available, she’d have a date set with you right now, for now, if you didn’t run away from facing her.
*”They flew in all their friends and family”* She could have them all there, and I’m so glad the interviewer called you out on that point at least.
It’s not a long process, just a simple formality, and this all has proven you can make exceptions when *you* want to.
This is just another example of being a traitor to your countries democratic process, a traitor to your country.

What scares me is that this could be exactly what Johnson wants.
If Arizona sues him over not swearing her in, I could very easily see him hiding behind the “Her case is currently tied up in the court system, so we can’t swear her in until that’s all resolved” excuse. And given that these cases can take months before a hearing is even scheduled, this would mean that he’d refuse to swear her in for months. And in the meantime, this would mean no release of the Epstein files. But I’m sure that that has absolutely nothing to do with this. No siree……
Would it make sense? No. The logic is totally nonsensical and self-serving.
Could it work anyway? Before 2025? No.
In *this* political environment, in front of a MAGA judge? Sadly, possibly.

If we don’t put him on trial for treason after Trump croaks I’m never going to forgive whoever gets elected.

How many times has he been asked if this is because of Epstein? At some point he’s got to realize he all think that’s the reason.
She should just go in and meet him with a reporter and ask to do it right there in the hallway. As far as I can tell that is allowed, it can be done outside of a formal session
