Trump asks, “WHAT THE HELL IS GOING ON?” What is going on is that your attempt at institutional capture isn’t going to happen so easily at the SCOTUS. Despite their personal ideologies and political affiliations, at their core, these are highly learned legal professionals, who have committed their lives to the jurisprudence. They are bound by the ethics of their profession to ask these questions and make careful assessments of precedent and intent. However, this in no way means the outcome is clear. My greatest fear is that they will know what the “correct” thing to do it (strike down the tariffs), but will not have the fortitude to take the consequences of their actions – disruptive refunds of the revenues collected, more uncertainty in the economy, etc. This would be a great failure to do their jobs, but it wouldn’t be the first time it’s happened.
