But if soldiers don’t follow illegal orders then it will be harder for Trump/GOP’s military takeover of America!

  2. While on active duty, under the 45th Commander in Chief, I denied unlawful orders. It’s called duty.

    Next.

  3. Every soldier and even police officers know that if you obey an unlawful order you’re on your own and looking at problems . The excuse that you were following orders will not help you

The unitary executive theory, through the lens of the Trump regime, would suggest that any order issued by the President is, in fact, legal. This is the change they’re getting at – are you loyal to the Constitution and the country or to the President, as Commander in Chief.

It’s entirely consistent throughout US history, and with any look at military or civilian law, to suggest that soldiers have an obligation to disobey an unlawful order, and perhaps even submit to a disciplinary process to determine if that’s true. On many fronts, consistent with authoritarianism, the regime wants an unthinking military with the President making the determination at to what is legal. And if people wonder why some suggest Trump is a fascist or a dictator, rejecting the consistency of our approach to such laws and norms and concentrating power to his office really does support that view.

  5. What’s the point of being a King if your soldiers don’t have to do everything you tell them?

Oh yeah, that whole 1776 thing…

  6. Just for those who might not know, the oath of enlistment:

    >”I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.”

Take special note the order of allegiance. Constitution…then orders from the President…then officers. So if the President’s or officers’ orders fail to follow the law of the constitution, then it should not be followed.

All the Dem video said is doing illegal things is illegal. The fact that this is some great controversy says a lot about where we are as a country.

  8. So Trump is essentially admitting that he is giving and/or planning to give unlawful orders. That would be the only reason to care about someone reminding soldiers to not follow unlawful orders.

Hegseth also has it wrong… just saw that he’s ordered some kind of BS investigation of Sen. Kelly for his comments on unlawful orders.

  10. Problem is, who is going to determine of an order is illegal and risk a court martial if they decide not to follow an order? Some enlisted person is gonna do what their officers or non-coms tell them to do. IMO, the risk is for the officers, non-coms if somebody in the next admin decides they violated international law etc.

Trump is purposely lying in an attempt to blur the line between lawful & unlawful… this all by design & typical for Autocrats.

  12. I love watching Trump and Hegseth Striesand Effect this whole thing into the military consciousness. They’re idiots, as usual.

  13. Trump doesn’t care about the consequences for a service-member, only loyalty. Look how everyone he taints with his being gets thrown under the bus when their usefulness expires.

Imagine being so stupid you conflate “illegal orders” with “Trumps orders” and don’t realize how bad that looks. That is MAGAts.

  15. he thinks that if he says it then it is legal. that is incorrect. he can say it and face no repercussions but that does not make it legal for others to act on it

  16. “When the president does it, it’s not illegal.” Nixon’s exact words, and the Republican ethos in a nutshell.

The problem is that all orders carry a presumption of ~~lawlessness~~ **lawfulness** unless obviously illegal, like “shoot the children”

Which is why it’s so important to get these internal deployments ruled illegal by courts. If orders have been found by a court to be illegal, then you must not obey them.

The “just following orders” defense didn’t fly in Nuremberg…sure as shit won’t fly here…I hope

Didn’t Trump fire a bunch of top level JAG lawyers in the military early on? Or did i dream that? Wouldn’t want pesky people around pointing out unlawful orders, huh?

  20. Every single service member swore an oath to refuse illegal orders.

Reminding them of their oaths is not sedition, it’s patriotism.

  21. The child raping fascist said something wrong that would grant him power to stay out of prison if true? Crazy.
