I can give some legal analysis on this.
The reason the arrests were found unlawful is because the judge held that officers didn’t check if the illegal immigrant was a “flight risk”.
The law requires for any immigration arrest without warrant, the person has to be “likely to escape”, meaning they can only arrest them without a warrant if they are a flight risk.
I haven’t dug into the government’s arguments but I think the government takes the position that “likely to escape” means “leave the scene”. That would apply to almost literally everyone so they don’t even ask questions like home, family, community ties.
The judge sees “likely to escape” as meaning “likely to go on the run”. So those questions and factors have to be considered.
Practically speaking, I don’t think this will change any operations. Federal officers will just keep claiming they think all undocumented immigrants are flight risks.

There needs to be some sort of reckoning. Start putting the people who command these yahoos in jail. Show them that there are repercussions. Fire them, toss them in jail, and then go after their superiors, all the way up the chain. Treat it like a RICO investigation.
