  1. From the article: “the Supreme Court is flirting with a maximalist version of executive power that facilitates an unaccountable White House — one that, for instance, blows up boats without due process. The court’s approach downplays the primary role that the founders assigned to Congress, making it the subject of Article I of the Constitution.

The justices also seem friendlier to claims of executive power under Mr. Trump than they were under President Joe Biden. They blocked Mr. Biden’s efforts to use his authority to forgive student loans and manage the Covid-19 pandemic. Today, they are enabling a Republican president as he goes much further while relying on weaker rationales.

Just as important, the justices are ignoring the evidence that Mr. Trump is not acting in good faith. In the past, the government has enjoyed what legal scholars call the “presumption of regularity.” Judges assume they can rely on government officials to present facts accurately and give true reasons for their actions — and can defer to those officials at times as a result. The Trump administration does not deserve this presumption.”

There’s no real principle at play, unless the principle is “Republicans should always do as they please”. As soon as a Democrat is in the White House again, they’ll start reeling the presidency back in. They’ll just make different stuff up that references whatever part of the constitution seems convenient, or can be conveniently used then.

After we forcibly removed the Republican Terrorist and Pedophile party of America from power, any member of SCOTUS found to support new age Republican nazi ideology needs to be charged with death sentence treason charges. The SC is our highest court and using it to support and pass nazi ideology against the united states needs dealt with harshly and we need to make an example that the United States is no longer a terrorist ran country

The MAGA Court doesn’t care about the Constitution. They care about free luxury RVs.

  5. It’s very clear to me that the SCOTUS conservative majority is in service of the Heritage Foundation. If you look at their rulings over the last 3 years it’s fairly obvious. They are also compromised due to bribes.

  6. The article doesn’t mention the work of the Heritage Foundation, it’s affilition with the existing justices, or the stacking of the court by Republicans at the end of Obama’s last term and the end of Trump’s first term. It’s not failing… it’s functioning exactly as conservatives have intended by ordering temporary stays on lower courts with out formally issuing decisions so they can let a conservative executive do whatever they want while allowing the opportunity to slam the door shut if/when they lose the presidency. They weren’t winning on populism so now they’re dismantling any process or institution that’s a threat to their political dominance. They’re not practicing typical jurisprudence where by they arrive at a decision by following the constitution, they have an outcome and perform legal gymnastics to justify their decision. The 6 members of the current court aren’t objective or impartial and are beholden to the forces that appointed them. Any article talking about the Supreme Court should mention needed reforms like term limits and expanding the court, anything less is underestimating the state of current events and where we’re headed as a nation.

  7. Its failing not just at *the one job that it has* but also at the only reason for its existence.

  8. Enabling Republicans, bribes, destruction of democracy?

I’d say the Christian conservatives have been extraordinarily successful by that metric.

  9. > Still, we continue to hope that the Supreme Court will yet restrain Mr. Trump’s unlawful actions.

The NYT editorial board continues to hope…

  10. If anyone is failing it’s been the damn useless Congress since pretty much president Obama’s second term

  11. Hmm, the NYT opinion pages. A place that has openly advocated for martial law within the past decade.

Why do people read this paper anymore?

The path to victory of these people was paved by liberal inaction and complacency, especially Merrick Garland and that decrepit corpse who couldn’t see past its nose Ruth Bader Ginsburg.

No their not failing at their job. Their job is to do the bidding of their masters that are paying for their lavish lifestyle. So in reality they are doing exactly what they are getting paid to do.

  14. When history looks back at this Supreme Court, it will be a toss-up as to who was worst, Justices on the bench during the Dredd-Scott decision or the current group of Justices.

It’s always conservatives/racists who fuck things up.
