    >Alabama leads the nation in pregnancy-related prosecutions, with most of the cases related to drug use, according to Pregnancy Justice.

Oh, look. A red state finally found something that they’re good at!

Too bad it’s not something that is actually beneficial to its residents.

Imagine being a man that needs so much control over a womans body that you call stillbirths and miscarriages murder just to punish them for a perceived slight

  3. It seems wrong to us the term “miscarriage of justice” here, both due to context, and because it doesn’t begin to describe how fucked up this whole thing is.

  4. It’s so sad to hear people (republicans, including women) defend the original decision to treat this as murder. How do they sleep at night being okay with that

  5. Wait, wouldn’t anything she told the hospital be privileged? Isn’t the whole point of doctor-patient confidentiality so that you can tell your doctor everything, especially in emergency situations, so they can treat you better?

I’m not even sure what exception this would fall under. No one was in imminent danger of harm, there was little to no risk of reoffending, and she wasn’t a danger to herself.

  6. It’s funny how riiight after these stories started happening, all of the ignorant, hateful, cruel, anti-choice people with whom I have argued and said this would happen stopped calling my arguments “straw man” arguments that just won’t happen. They all disappeared

Alabama, maybe you should look at why someone like her would start using meth. Remind me… where does Alabama rank in education? Where does it rank in poverty?

  8. Can’t imagine any sane jury that would convict her, except when you get old people on the jury and any drug involvement makes you guilty.

18 years is a little tough but it’s definitely manslaughter and they should at least have some court required drug counseling. They did in fact kill their baby with gross negligence and that’s not nothing

So where does this end? Suppose someone with a terrible diet miscarries – were they responsible for murder? Someone who declines to take prenatal vitamins? What standard of care for fetuses do we intend to enforce?

I have a question for anyone who understands these laws—does this apply to women who don’t know they’re pregnant? I.e., a woman is a heavy drinker in poor health who doesn’t get periods anyway, and doesn’t know she’s pregnant til she miscarries—can she be charged with murder also because she drinks? How do they find out this information anyway?
