I’m curious, what does it take to be considered trans in these cases? Is it the principle that people simply are what they say they are, or does it require some type of documentation of gender-affirming care or diagnosis?

As a trans American, I continue to believe the matter is easily solvable by removing all sex and gender markers from passports, driver’s licenses, official IDs, etc., where identifying you does not need to involve a genital check. In the hospital, providers need a inventory check, but this ID data is information that simply serves no purpose. Legal name, legal address, date of birth, does the photo look like you. That’s all you need. Can we just have an issue, one issue, related to the trans community where a freaking adult is in charge?!

That is correct.

I don’t even understand MAGAs end game with this.
If a transwoman has an ID that says “Male” on it, and someone questions them about it, they can just say, “It’s because I’m a transwoman, and I legally have to have ‘male’ on my ID.”
What is the other person gonna do in that situation? If they’re at an airport, are they gonna *not* let them fly because they’re trans? If they get pulled over by the cops, are they going to get a ticket for being trans? I just don’t understand what the “gotcha” here is for MAGA or how it helps them in any way.

What about the sizable population of people who just say they don’t want to support the patriarchy so they’re not going to accept any gender identity or they’re going to change their gender identity? We know that something like 1% of the population identifies as trans but only something like one out of 20,000 suffers from gender dysphoria. So that other big group can mean a lot of different things.
If gender was removed from the drivers license…doesn’t this become a non issue?

First…HELL YEAH!
Second…Gender v Sex. Isn’t sex the biological marker and gender the more fluid identifier? Or in this case is “sex discrimination” being used as an all-encompassing term to hold both types under the umbrella?

(1) The idea that your gender is in any way relevant to identity documents is absurd.
(2) Why do people obsess so much over the shape of other people’s junk.

And we still have some fuckstick in the MT AG’s office who wants to behave as if intersex people simply don’t exist. This is an issue that should only present an actionable difference in treatment between individuals and their doctors/nurses, and nowhere else.
> The Montana Attorney General’s Office, on the other hand, expressed outrage in an anti-trans statement.

My uninformed opinion is that we don’t need gender/sex markers on IDs, I only see that information being relevant in a medical setting or social/romantic setting.

A big issue here is that conservatives’ understanding of trans women is that they are straight male pedophiles who are fat, bald, and hairy, and they only cross dress to try to get into women’s bathrooms so they can rape little girls.
And they don’t even think about trans men.
There are tons of trans people who pass so well that you would never guess they are trans.
Forcing passing trans people to identify as the opposite sex is going to create problems.

I wonder about the unintended consequences of reinforcing the anti-scientific and pro-bigotry belief that gender is defermined by sex. Probably overall a positive ruling, but it seems like it’s going to cause more serious problems in the future.
