Some fun thoughts: I am not a colonizer – I have lived here all my life as did my parents before me. I have not been a participant in any war nor genocidal activity. I have no idea whether or not my home sits on “tribal fishing or hunting grounds”, but I promise the pickings would be pretty slim, save the odd squirrel or crow. I do agree that treaties were signed & governments have a duty to abide by them, except there must also be some sanity in the matter. Of the treaty was written >100 years ago, why is the current government expected to live up to it, chapter & verse ? Allowances need to be made or the whole Reconciliation Industry would have all non-Indegenous people removed from Canada. I want there to be fair & reasonable accommodations made, but giving up large swaths of the Lower Mainland to indigenous lands claims seems to be the opposite of that. Especially when others like me (non-genocidal, non-signatory, non-colonizers) purchased our homes in good faith. Where is the good faith in return ?

Every constitutional lawyer in the country has known the lack of treaties in BC was a ticking bomb. FNs have been trying to negotiate claims for decades. Nothing here is a surprise.
When negotiations with the feds failed, the lawsuits started.
This has also been a ticking bomb. For decades in the early 20th Century, the Indian Act forbade (or had the chilling effect of forbidding) FNs from hiring lawyers. Every single government since Confederation knew they had trampled on the treaties, ignored sections of the Manitoba Act, and even refused to recognize FNs in BC.
My personal theory is that Mulroney, lawyer he was, knew all this, knew the lawsuits were coming, and tried to set up a process to settle land claims, potentially for pennies or dimes on the dollar. But Meech failed, we got Chrétien and …
I don’t know what the solution is. But I do know that the courts will generally side with FNs as a matter of law. And, as a matter of law, recognize Canada has been acting in bad faith for over a century. And that means penalties.
TBH, we should be more pissed the issues weren’t resolved decades ago. But the feds kept on kicking the can and now the road is running out.
