The unitary executive theory, through the lens of the Trump regime, would suggest that any order issued by the President is, in fact, legal. This is the change they’re getting at – are you loyal to the Constitution and the country or to the President, as Commander in Chief.
It’s entirely consistent throughout US history, and with any look at military or civilian law, to suggest that soldiers have an obligation to disobey an unlawful order, and perhaps even submit to a disciplinary process to determine if that’s true. On many fronts, consistent with authoritarianism, the regime wants an unthinking military with the President making the determination at to what is legal. And if people wonder why some suggest Trump is a fascist or a dictator, rejecting the consistency of our approach to such laws and norms and concentrating power to his office really does support that view.

Just for those who might not know, the oath of enlistment:
>”I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.”
Take special note the order of allegiance. Constitution…then orders from the President…then officers. So if the President’s or officers’ orders fail to follow the law of the constitution, then it should not be followed.

Problem is, who is going to determine of an order is illegal and risk a court martial if they decide not to follow an order? Some enlisted person is gonna do what their officers or non-coms tell them to do. IMO, the risk is for the officers, non-coms if somebody in the next admin decides they violated international law etc.

Which is why it’s so important to get these internal deployments ruled illegal by courts. If orders have been found by a court to be illegal, then you must not obey them.
