There’s no real principle at play, unless the principle is “Republicans should always do as they please”. As soon as a Democrat is in the White House again, they’ll start reeling the presidency back in. They’ll just make different stuff up that references whatever part of the constitution seems convenient, or can be conveniently used then.

It’s very clear to me that the SCOTUS conservative majority is in service of the Heritage Foundation. If you look at their rulings over the last 3 years it’s fairly obvious. They are also compromised due to bribes.

The article doesn’t mention the work of the Heritage Foundation, it’s affilition with the existing justices, or the stacking of the court by Republicans at the end of Obama’s last term and the end of Trump’s first term. It’s not failing… it’s functioning exactly as conservatives have intended by ordering temporary stays on lower courts with out formally issuing decisions so they can let a conservative executive do whatever they want while allowing the opportunity to slam the door shut if/when they lose the presidency. They weren’t winning on populism so now they’re dismantling any process or institution that’s a threat to their political dominance. They’re not practicing typical jurisprudence where by they arrive at a decision by following the constitution, they have an outcome and perform legal gymnastics to justify their decision. The 6 members of the current court aren’t objective or impartial and are beholden to the forces that appointed them. Any article talking about the Supreme Court should mention needed reforms like term limits and expanding the court, anything less is underestimating the state of current events and where we’re headed as a nation.
